Texas Vape Ban Update: What SB 2024 Means for You

1) The Countdown Is On

Texas hemp law is shifting fast. On September 1, 2025, Senate Bill 2024 (SB 2024) takes effect, banning all e-cigarette and vape products that contain—or even just claim to contain—cannabinoids. That includes both THC and CBD vapes.

To keep things clear, here’s what’s changing and why we’ve already made adjustments for our Green Relief community.


2) What Exactly Is Banned?

SB 2024 widens the definition of “e-cigarette” to cover any vaporized liquid or material, even if it doesn’t contain nicotine. That means hemp vapes are squarely in the crosshairs.

Starting Sept 1, banned vape products will include:

  • Devices and cartridges containing cannabinoids (Delta-8, Delta-9, THCa, CBD, etc.)

  • Kid-appeal packaging: cartoons, candy graphics, celebrity likenesses

  • “Disguised” vapes: items made to look like highlighters, pens, watches, cosmetics, or toys

  • Certain imports: devices manufactured in, or marketed as from, China or other U.S.-designated “foreign adversary” countries


3) The Penalties Are Serious

Violations after Sept 1 are Class A misdemeanors. That’s up to $4,000 in fines per violation—and even possible jail time. This is a sharp step up from past enforcement.


4) What’s Still Legal

This ban does not apply to:

  • Gummies, tinctures, drinks, capsules, and topicals

  • Prescription medical devices or products under Texas’ Compassionate Use Program (TCUP)

So while vape products are out, most hemp-derived edibles and wellness products remain available.
